Is Online Gambling Legal in the Netherlands?

Yes, since October 1, 2021, online gambling is legal in the Netherlands. But only at gambling sites with a license from the Gaming Authority in The Hague.

All other online casinos that you can find on the internet – and there are thousands of them – are therefore not legal. The owners of these sites are punishable for offering gambling games without a license. And if you play there, you are also officially punishable, although the chance that you will get a fine for this is very small.

Legal Gambling in the Netherlands: The History

Before October 1, 2021, gambling on the internet was prohibited. Of course, many Dutch people still took a chance online, on sites with a license from another country such as Malta, Antigua, or Curacao. But officially that was not allowed; the Gambling Act dated from 1964 and at that time the internet did not yet exist.

Since the rise of the internet, there have been various plans in The Hague to legalize online gambling. There were good reasons for this. Modern legislation and strict supervision would ensure a safer and fairer gambling offer. The government would also be able to combat illegal providers better and there would be more opportunities to prevent addiction.

Initially, the idea was to grant the state-owned company Holland Casino the only party to receive a license – this way, gambling profits would flow neatly into the state treasury, and politicians like that.

However, it never happened, except for a test site (in 2000) and a pilot with free digital casino games (in 2004).

In 2012, there seemed to be a breakthrough. The coalition agreement of the Rutte-II cabinet was clear: ‘We are modernizing the gambling policy. Online gambling, sports betting, and poker events will be strictly regulated. In this way, we are reducing the illegal supply of gambling.’

The target date for the new Remote Gambling Act (KOA) was January 1, 2015. This would finally make online gambling legal in the Netherlands.

But the introduction of the new gambling law was delayed time and again, thanks to bickering and stalling politicians in the House of Representatives and the Senate.

It wasn’t until October 1, 2021, that the gambling market finally opened up. Ten companies, including of course the state-owned companies Holland Casino and Nederlandse Loterij, were allowed to get to work. Since then, many licenses have been added and Meneer Casino expects some new providers on the market in 2024.

All online casinos with a Dutch license must comply with the KOA Act plus a whole package of regulations. These rules state, for example, that the games must be 100% fair and that the casinos must do everything they can to prevent a player from becoming addicted to gambling.

The Gaming Authority strictly monitors this. If a casino does not comply with the rules, it will be fined and in the worst case, the license will be withdrawn.

Moreover, the regulations are becoming increasingly strict. In the first months, you could get a bonus at most gambling sites if you were not yet 24 years old; that is no longer allowed. Things like autoplay, cashback bonuses, and most bonus buy slots are now also prohibited.
